The Republic of Austria. Legalization and translation:
The Republic of Austria is a party to the 1961 Hague Convention.
    The Hague Convention Abolishing the Requirement of Legalisation for Foreign Public Documents (the Apostille Convention or the Apostille Treaty), is an international treaty. It specifies the modalities through which a document issued in one of the signatory countries can be certified for legal purposes in all the other signatory states. A certification under the terms of the convention is called an apostille.

Austrian Land Registry:

Austrian Land Registry (Grundbuch) contains information on residential and non-residential real estate, land plots (including type of use), property rights to them, mortgages, easements and encumbrances.

Proprietary rights can only be acquired by registering in the Austrian Land Registry. Everyone can rely on the accuracy and completeness of the information in the Austrian Land Register (so-called trust principle).

The land registry is maintained by Austrian district courts. The Austrian land registry consists of two parts:

  • land registry (includes information on current registration)
  • document register (e.g. sales agreement)

The register includes a list of coordinates (documents for determining the position and borders of property), plans and aerial photographs, cadastral map and site catalogue.

The beneficial owner registry in Austria was established on January 15, 2018.
Since January 10, 2020 part of the information of the beneficial owner registry became available to the public in the form of an extract from the beneficial owner registry (no search by beneficiary, only by company).
In some cases, information on the beneficial owners is classified. This is due to the security of these persons and the possible threat to their lives. In this case, the extract from the register of beneficiaries will contain information about the restriction of access.
Legal persons in Austria are obliged to identify and verify their beneficiaries once a year.
